Regulations of wholesale (applies to entrepreneurs):

1. General conditions.

    Bamal Europe LP Sp.k Branch in Poland conducts wholesale sales in accordance with the presented offer on the website www.bamal.pl. All offered products are brand new and covered by the manufacturer's warranty.
    The offer is directed exclusively to companies, institutions and persons conducting business.
    Individual retail orders are carried out in accordance with the posted retail offer.
    The prices of all goods on offer are given in PLN.
    The offer includes visible net and gross prices.
    Buyers on Polish territory are charged 23% or 8% VAT to the prices, depending on the product.
    Order realization period is up to 3 working days from order confirmation (as an order acceptance date in case of transfer payment we consider the day of booking the payment, and in case of cash on delivery - the day of receipt of the order by the company). In exceptional cases, the order deadline may be extended for reasons beyond the control of the supplier, the buyer will be informed of the extended delivery date before 7 days from the date of the order.
    The condition for making orders is to place an order on our website www.bamal.pl after obtaining the status of a wholesaler. In exceptional situations, it is possible to place an order by phone at telephone number: 793 495 425
    Ordering parties declare that they have familiarized themselves with the content of these regulations, which they understand, and placing an order means that all provisions of these regulations become an integral part of the contract concluded as a result of placing an order and its confirmation, unless they are expressly excluded by the supplier. Those placing an order undertake to comply with the Regulations in their entirety.
    Orders are accepted every day 24 hours a day by e-mail and by phone from Monday to Friday from 8 a.m. to 4 p.m. Orders placed on weekdays after 2:30 p.m., on Saturdays and on Sundays and holidays are processed on the next working day.
    The minimum value of a wholesale order is PLN 1500 gross. Bamal Europe LP Sp.k Branch in Poland also reserves the right to add 5% for non-carton purchases.
    Each order is confirmed electronically or by phone by an employee of Bamal Europe LP Sp.k Branch in Poland, so the buyer is required to provide a valid phone number or company email. Orders without the phone number provided will not be realized or their realization may be prolonged through the fault of the buyer.
    Promotions valid on www.bamal.pl apply to orders placed through the online store. At points of sale the prices of products in PROMOTION are not taken into account.
    The seller reserves the right to withhold, cancel or change the terms of the order if:
    within 3 working days from the receipt of the order it is not possible to contact the ordering party by phone or e-mail.
    The amount of prepayment has not been paid within 7 working days of the order (applies only to orders with transfer payment to the account of the company Bamal Europe LP Sp.k Branch in Poland).
    The data given in the order are false.
    The ordering party will be immediately informed of the above fact by one of the means of communication, with the exception of the situation where the ordering party has not provided a valid telephone number.
    Once the order is confirmed and an invoice is issued, a contract for the sale of goods is concluded between Bamal Europe LP Sp.k Branch in Poland and the Purchaser.
    Placing an order by the Purchaser is tantamount to authorization to issue an invoice without the need to obtain his signature.
    Bamal Europe LP Sp.k Branch in Poland conducts, "receipt" sales so the buyer can specify what type of document is to be issued after the order.
    Bamal Europe LP Sp.k Branch in Poland carries out orders within Poland and the EU (provided that the purchaser is an active EU VAT payer).
    All goods until unpaid deferred invoices are the property of Bamal Europe LP Sp.k Branch in Poland.
    Despite our best efforts, we do not guarantee that the published technical data (descriptions/photos) do not contain omissions or errors. However, since possible errors cannot be the basis for claims, in case of doubt, please contact the seller before deciding to purchase.
    In accordance with Article 17 of the Law on Copyright and Related Rights, it is prohibited to use studies available on the site, i.e. data sheets and sheets and photos in any form without the prior consent of the author, under penalty of legal consequences (Bamal regulations) and financial (fine from 50 thousand zlotys). This provision does not apply to studies for products purchased from Bamal.
    1.Buyer is obliged to comply with the payment deadline set by the company Bamal Europe LP Sp.k Branch in Poland, but if it is exceeded, the company has the right to charge statutory interest or maximum interest under Article 359 of the Civil Code.
    In case of payment delays of more than 30 days, the case is forwarded to the insurer Euler Hermes, and the client is charged with the costs of collection, which amount to 6% net + VAT on the amount of the document being collected. At the same time, the documents are also forwarded to a lawyer who conducts further debt collection proceedings, resulting in legal fees charged to the buyer in the amount of PLN 250 net, i.e. PLN 307.50 gross (written debt collection) or PLN 150 net, i.e. PLN 184.50 gross for electronic debt collection.
    Interest notes are sent once a week at the expense of the buyer (the cost is 50 PLN for each letter sent).

    The company Bamal Europe LP Sp.k Branch in Poland uses the services of the receivables insurance company Towarzystwo Ubezpieczeń Euler Hermes S.A. and Euler Hermes Collections Sp. z o.o., so each buyer is verified by them. The insurer receives from Bamal Europe LP Sp.k Branch in Poland data such as the TIN of each company that made the purchase and its billing history.
    Company Bamal Europe LP Sp.k Branch in Poland is not responsible for shortages of goods from orders not finalized by the buyer until 24 hours after the selection of goods on the site.
    Company Bamal Europe LP Sp.k Branch in Poland is not responsible for shortages in goods from orders not collected by the buyer, who did not specify the date of receipt of goods - WE DO NOT RESERVE GOODS.
    Goods ordered to be postponed for several or more days ahead IS NOT postponed on the date of receipt of the order, but on the date of its receipt, which may result in shortages due to the redemption of the product.
    Bamal Europe LP Sp.k Branch in Poland is not responsible for damages caused by an incomplete carton order.
    Wholesale orders are not realized as packages up to 30kg. Such a parcel is sent only at the request of the customer and at his responsibility. The customer declares that he covers any damage caused during transport. We do not ship liquid products, applies to wholesale and retail orders.
    Bamal Europe LP Sp.k Branch in Poland informs that during the execution of the order additional order may be placed j only until 12:00 p.m. Any order placed after this hour will be treated as a separate shipping order for the next working day.
    Each customer is obliged to cover the purchased goods with stickers with translations in Polish. Stickers are printed for the document in question.
    Printing of stickers is free of charge.

2 Delivery of goods:

    Shipping costs of the goods shall be borne by the buyer.
    Goods are delivered to the customer through SUUS freight forwarders.
    Bamal Europe LP Sp.k Branch in Poland is not responsible for any delays caused by the fault of transport companies delivering the purchased goods.
    For ordering the shipment of a pallet and not receiving it, the cost of transportation and return of the shipment to our warehouse is borne by the buyer.
    All costs associated with the shipment and non-collection of the shipment charged by third-party companies shall be borne by the purchaser.
    The blue pallets on which the shipment of goods takes place are the property of CHEP and must be released at the request of a representative of the company.
    Failure to provide a delivery address (and failure to contact the person specified in the order) will result in shipment of the pallet to the address specified on the invoice (order).

3 Complaints:

    In case of any shortages of goods or damage caused during transport, the complaint protocol is the basis for consideration of complaints.
    Any complaints should be reported up to a maximum of 5 working days after receipt of goods, only by e-mail to: reklamacje@bamal.pl.
    In the e-mail you should send photos of the damage, a description of the damage and the protocol written with the driver.
    Confirmation of acceptance of the application is a reply back to this e-mail with a number, which is assigned to the complaint.
    The time for processing a complaint is 14- 30 days. In exceptional situations this time may be extended.
    Receiving the goods, the Purchaser is obliged to check whether the shipment does not have any damage caused during transport.
    The condition for consideration of a possible complaint regarding mechanical damage and quantitative deficiencies arising during transport is to write in the presence of an employee of the transport company "Complaint Protocol".
    Purchased goods are not subject to return in the case of incorrectly provided by the customer order data. This is also not a basis for justifying a complaint.
    In the event of an unfounded complaint, the cost of handling, inspection and delivery of the goods to the Seller, and after inspection to the Buyer, shall be borne by the Buyer.
    After reviewing the case, the decision is sent by e-mail to the e-mail address from which the application was received.

4 Right of return:

    Within 14 days from the delivery of the ordered product, the Buyer has the right to return it without giving reasons under the withdrawal from the contract, according to the general rules under the Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by dangerous products (Journal of Laws No. 22, item 271), by submitting to Bamal Europe LP Sp.k Branch in Poland a statement in writing. If the returned goods meet the requirements for return acceptance, a correction invoice is issued. The original and a copy are sent to the customer by priority mail. The customer should send back a signed copy of the corrective invoice, and upon receipt, within 14 working days, Bamal Europe LP Sp.k Branch in Poland shall refund the customer's account.
    The return shipment should be accompanied by a statement of withdrawal from the contract and the account number to which Bamal Europe LP Sp.k Branch in Poland is to return the payment.
    The warranty and other rights provided by law, including the right to withdraw from the contract do not apply when the product is affected by mechanical damage of external origin. We would like to remind you that you should always check that the packaging has not been damaged in transit before taking delivery. In particular, pay attention to the condition of the packaging or tapes stuck on the parcel. Checking the shipment upon receipt is an essential condition for taking into account any claims of the customer for damage or robbery of the shipment in transit.

5 Data protection and legal consent to send advertising

    Based on the approved terms and conditions of sale and the purchase agreement, the customer agrees that Bamal Europe LP Sp.k Branch in Poland, for the purposes of its own marketing, may research, process and use his personal data that he has provided to Bamal Europe LP Sp.k Branch in Poland, including on the basis of the compilation of a customer database.
    The customer agrees that Bamal Europe LP Sp.k Branch in Poland may send unsolicited offers by e-mail or other comparable means of data transmission as part of the advertising activities undertaken. Such consent may be revoked by the customer at any time.
    The customer consents to the processing of his personal data within the Bamal Group.

6 Final provisions:

    The content of the offer of Bamal Europe LP Sp.k Branch in Poland does not constitute a commercial offer within the meaning of Article 543 of the Civil Code.
    All customer data provided during the registration-submission of the order are processed in accordance with the Act on the Protection of Personal Data of August 29, 1997 and are used only to carry out the order and are not shared with third parties.
    All products and names mentioned are used for identification purposes only and may be registered trademarks.
    Product images and colors may differ slightly from the actual appearance.
    By placing an order, the "Buyer", accepts the above regulations.
    The court of competent jurisdiction for disputes that may arise in connection with the contract of sale or any other contract concluded with Bamal Europe LP Sp.k Branch in Poland shall be the court of competent jurisdiction for the Podgórze District of Cracow or the court of general jurisdiction of Bamal.
    Changes in the rates of penalties, interest, costs and other charges provided for herein do not require the Buyer's approval and shall occur automatically without the need to notify the Buyer of the change.
    In all matters not covered by the above Regulations, the provisions of the Civil Code shall apply.

The company limits the use and collection of information to the minimum necessary to provide you with the best possible service. You have the opportunity to opt out of receiving electronic mailings. You have the right to inspect your own data, change them or request their deletion and stop their processing.
    The personal data entrusted to us by you is stored and secured in accordance with the principles set out in the applicable laws: the Act of 29.08.1997 on the protection of personal data (consolidated text Journal of Laws No. 101 of 2002, item 926, as amended). Act of 18.07.2002 on providing services by electronic means (Journal of Laws No. 144, item 1204, as amended). Decree dated 29.02.04r. Minister of Internal Affairs and Administration regarding documentation of personal data processing and technical and organizational conditions to be met by devices and IT systems used for personal data processing (Journal of Laws No. 100,item 1024).

2 Orders

    Placing an order at bamal.pl means that you have read and accepted the terms and conditions. Confirmation of acceptance is done by checking the appropriate box when placing an order.
    Orders are placed via www.bamal.pl.
    The order can be placed by adults or minors with the consent of their legal guardians.
    Orders can be placed through:

                       (a) online store (www.bamal.pl),

                       b) e-mail: sklep@bamal.pl, hurt@bamal.pl

                       c) by phone: 793 495 425

    Goods offered by bamal.pl are available worldwide through SUUS, a courier company.
    Orders can be placed 24 hours a day, all year round.
    The prices of goods visible on the website www.bamal.pl, are gross prices expressed in PLN.
    The value of the discount the customer is entitled to is visible after finalizing the order.
    Placing an order is tantamount to:

                       a) consent to the processing of your personal data for the needs of the store,

                       b) consent to the conclusion of a sales contract,

                       c) acceptance of these regulations.

3 Shipping

    Orders are shipped on working days applicable in Poland from Monday to Friday from 7.00 am to 3.00 pm.
    The period of realization (shipping) of the order is a maximum of 14 working days. The date of receipt of the shipment by the customer depends on the selected form of shipment. In 90% of cases the ordered goods reach the customer within 3d working days.
    The bamal.pl store reserves the right to refuse to process questionable orders - in this case the customer will be informed by e-mail or telephone. bamal.pl is not obliged to give the reason for the cancellation of the order.
    Shipping costs shall be borne by the buyer (according to the price list of SUUS).
    Payment for the ordered goods can be made by cash on delivery at the deliverer (letter carrier) at the time of receipt of the goods or by bank transfer to the bank account of the store bamal.pl. In case of payment by bank transfer, the ordered goods will be sent to the Buyer after the amount due is credited to the bamal.pl account.
    We check the account balance 7 days a week from 8.00 a.m. to 3.00 p.m. Due to the working time of banks and post offices, shipping orders placed at the end of the week will be processed on working days.
    Parcels via couriers are shipped from Monday to Friday.
    Personal pick-up is possible in the area of Cracow.
    The day of placing an order and making payment is not the same as the day of shipment.

4 Returns and complaints

    Returned goods are sent back to us at your own expense. We will refund the price you paid for the product within 14 working days from the date of receipt of the returned goods, (please remember to send us the account number to which the payment for the goods is to be transferred, this will shorten the waiting time for the money).
    All products in our offer are covered by the manufacturer's warranty.
    Complaints about mechanical damage caused during transport and lack of goods inside the packaging will be considered only at the time of receipt of goods in the presence of the forwarder. The condition for the acceptance of this type of complaint will be to write a complaint protocol with the deliverer.
    Theft of goods sent by mail or courier service is not common, but nevertheless happens, and only compliance with the rules mentioned above will allow you to successfully claim for this type of damage and protect the buyer from possible losses.
    The cost of delivery of the advertised product for repair, the cheapest form within the complaint is paid by the buyer. This cost will be immediately reimbursed when the complaint is accepted.
    In case of failure to conclude the transaction, the buyer is obliged to pay 8% from the value of the order to cover the costs associated with it.

5 Final provisions

    The bamal.pl store is not responsible for improper use of the purchased products.
    In matters not covered by these Terms and Conditions, the provisions of the Civil Code shall apply. bamal.pl reserves the right to change the Terms and Conditions without prior notice to customers registered on the site. All changes are effective from the date of their publication on the bamal.pl website.
