Wholesale regulations (applies to entrepreneurs)
§ 1. GENERAL CONDITIONS
1. The owner of the online wholesale store operating at www.bamal.pl is: Bamal Europe LP Sp.k. Branch in Poland Kokotów 1022; 32-002 Kokotów; NIP: PL6793215051 KRS: 0000899404. District Court for Kraków-Śródmieście in Kraków.
2. The Seller conducts wholesale sales of products in accordance with the offer presented on the website www.bamal.pl.
3. All products offered are brand new and covered by the manufacturer's warranty.
4. The offer is directed exclusively to companies, institutions and individuals running a business.
5. Individual retail orders are fulfilled in accordance with the posted retail offer and in accordance with the retail regulations.
6. Prices of all goods offered are given in PLN.
7. The offer includes both net and gross prices. For buyers in Poland, VAT is added to the prices at 23%, 8%, or 5%, depending on the product.
8. The order processing time is up to 3 business days from order confirmation (in the case of bank transfer payments, the date of order acceptance is the date the payment is credited, while in the case of cash on delivery payments, the date the order is received by the company).
9. In exceptional cases, the order fulfillment time may be extended for reasons beyond the supplier's control; the buyer will be informed of the extended delivery time within 7 days of the order date.
10. The condition for placing orders is to place an order on the website www.bamal.pl after obtaining the status of a wholesaler (activation of a wholesale account on the website www.bamal.pl by a Bamal employee).
11. Persons placing orders declare that they have read and understood the content of these regulations, and by placing an order, all provisions of these regulations become an integral part of the contract concluded as a result of placing the order and its confirmation, unless they have been expressly excluded by the supplier.
12. Those placing an order undertake to comply with the Regulations in their entirety.
13. Orders are accepted electronically 24 hours a day. Orders placed on weekdays after 2:30 p.m., on Saturdays, Sundays, and public holidays will be processed the next business day.
14. The minimum wholesale order value is PLN 1500 gross. Bamal Europe LP Sp.k. Branch in Poland also reserves the right to add a 5% surcharge for purchases of less than a carton.
15. Each order is confirmed electronically via the email address provided during account registration. Therefore, the buyer is required to provide an active, current phone number or company email address. Orders without an active phone number/email address will not be processed or may take longer to process due to the buyer's fault.
16. Promotions valid on the website www.bamal.pl apply to orders placed via the online store; at points of sale, the prices of products in the PROMOTION are not included.
17. The Seller reserves the right to suspend, cancel or change the terms of the order if it is not possible to contact the ordering party by telephone or email within 3 business days of receiving the order.
18. The Seller may cancel an order if the prepayment amount has not been received within 7 business days of placing the order (applies only to orders with bank transfer payments) or if the information provided in the order is incorrect. The Ordering Party will be informed immediately, provided they have provided valid contact information.
19. After confirmation of the order and issuing of the invoice, a goods sales agreement is concluded between Bamal Europe LP Sp.k. Branch in Poland and the Buyer.
20. Invoicing Rules (KSeF): As of February 1, 2026, Bamal Europe LP Sp.k. Branch in Poland issues structured invoices via the National e-Invoice System (KSeF). Placing an order constitutes authorization to issue an e-invoice without the need for the Buyer's signature.
21. A transitional period will apply until March 31, 2026, during which invoices will also be sent to Buyers in paper or electronic format (PDF visualization). From April 1, 2026, the only accounting document is the invoice in the KSeF system. Documents sent by email after this date are for informational purposes only.
22. Bamal Europe LP Sp.k. Branch in Poland fulfills orders in Poland and the EU.
23. All goods until unpaid invoices with deferred payment date are the property of Bamal Europe LP Sp.k. Branch in Poland.
24. Despite our best efforts, we cannot guarantee that the published technical data (descriptions/photos) are free from omissions or errors. Any errors cannot constitute grounds for claims.
25. In accordance with the Copyright Act, it is prohibited to use studies, data sheets, and photos from the website without the author's prior consent, under penalty of legal and financial consequences (fines of up to PLN 50). This provision does not apply to products purchased from Bamal.
26. The Buyer is obliged to comply with the payment deadline; in the event of delay, the Company has the right to charge statutory or maximum interest.
27. In case of payment delays exceeding 30 days, the case is transferred to the insurer Euler Hermes, and the client is charged collection costs of 6% net + VAT of the document amount. Additionally, the client is responsible for legal fees of PLN 250 net (written collection) or PLN 150 net (electronic collection).
28. Each buyer is verified by the Euler Hermes SA Insurance Company, to which Bamal provides data such as the Tax Identification Number and settlement history.
29. The company is not responsible for shortages in goods from orders not finalized by the buyer within 24 hours after selecting the goods on the website and for uncollected orders - WE DO NOT RESERVE GOODS.
30. Goods ordered for collection at a later date are postponed until the planned collection date, which may result in shortages.
31. The company is not responsible for damage incurred during transport of orders less than full cartons. Wholesale orders are not shipped as parcels up to 30 kg – such shipments are only made at the request and responsibility of the customer, who covers the costs of damage. We do not ship liquid products in parcels.
32. Additional orders can only be placed if the order status is "Order Submitted" or "Waiting for Completion." Any other status is treated as a new order.
33. Each customer undertakes to affix stickers with a Polish translation to the goods, which are printed for the document free of charge.
§ 2. DELIVERY OF GOODS
1. The costs of shipping the goods are borne by the buyer.
2. Goods are delivered via JAS FBG. The company is not responsible for delays caused by transport companies.
3. In the event of failure to collect the ordered pallet shipment, the buyer shall bear the shipping costs in both directions.
4. CHEP Blue Pallets are the property of CHEP and must be issued upon request.
5. If there is no delivery address and no contact with the ordering party, the pallet is sent to the address on the invoice.
§ 3. COMPLAINTS
1. The basis for complaints about shortages or transport damage is the complaint protocol.
2. Complaints should be submitted within 5 working days of receipt exclusively to the following address: reklamacje@bamal.pl, sending photos, a description of the damage and a report drawn up with the driver.
3. A response with a complaint number will confirm receipt. The processing time is 14-30 business days.
4. The buyer must check the shipment in the presence of the courier; the lack of a damage report prepared upon receipt of the shipment may make it difficult or impossible to pursue claims for damage incurred during transport, in particular against the carrier.
5. Purchased goods are not subject to return if the customer provides incorrect information.
6. In the event of an unjustified complaint, the handling and transport costs shall be borne by the Buyer.
§ 4. RIGHT TO RETURN
1. A buyer who is an entrepreneur does not have the right to withdraw from the contract or return the goods without giving a reason. The parties exclude the application of the provisions on withdrawal from a distance contract.
2. Returns may only be made on the basis of individual written arrangements with the Seller.
3. The Seller's liability in B2B transactions does not cover damage occurring after the goods are delivered to the Buyer. Failure to file a damage report with the carrier may prevent the pursuit of claims.
4. Pursuant to Article 558 §1 of the Civil Code, the parties exclude the Seller's liability under the warranty for defects in goods in trade between entrepreneurs.
§ 5. PERSONAL DATA PROTECTION (GDPR)
1. The Client consents to the processing of his/her personal data for marketing purposes of Bamal Europe LP Sp.k. and within the Bamal Group.
2. The customer consents to receiving advertising offers electronically. This consent may be revoked at any time.
3. All data is processed in accordance with the currently applicable provisions on personal data protection (GDPR) and used only for the execution of orders and the Seller's own purposes.
4. Detailed consents regarding the processing of personal data and marketing communications are expressed by the Customer during the account registration process and may be withdrawn at any time.
§ 6. FINAL PROVISIONS
1. The content of the website does not constitute a commercial offer within the meaning of the Civil Code.
2. All names and marks are used for identification purposes and may be trademarks. Images may differ slightly from actual appearance.
3. By placing an order, the Buyer accepts these regulations.
4. The court having jurisdiction to resolve disputes is the court having jurisdiction over the Podgórze District in Kraków or the court of general jurisdiction in Bamal.
5. Changes to penalty rates, interest and costs occur automatically without the need for separate notification.
6. In matters not regulated, the provisions of the Civil Code shall apply.

Retail Sales Regulations (for consumers)
§ 1. GENERAL PROVISIONS

3. The Regulations define the rules for using the Store, placing orders, delivering goods, the right to withdraw from the contract and the rules for complaints.

§ 2. ORDERS AND PRICES
1. Product prices displayed on the website are gross prices (including VAT) and are expressed in Polish zloty (PLN). The price does not include shipping costs, which are added during the ordering process.
2. Orders can be placed 24 hours a day, 7 days a week.
3. The sales contract is concluded upon confirmation of the order being accepted for execution by the Store.
4. The Store advises that it does not reserve goods for a period longer than the time necessary to pay for the order. Goods are prepared for shipment after payment is received or after the "cash on delivery" option is selected.
§ 3. PAYMENT AND DELIVERY
1. Available payment methods: a) Traditional transfer to the Store's bank account, b) Payment on delivery (cash on delivery);
2. Delivery within Poland is via courier. Personal collection in Kokotów is possible by prior arrangement.
3. The order processing time is from 3 to 14 business days, and the Store makes every effort to ensure that 90% of parcels are shipped within 3 business days.
4. Delivery costs are borne by the Buyer, unless the offer states otherwise.
§ 4. RIGHT TO WITHDRAW FROM THE CONTRACT (RETURNS)
1. A consumer and a natural person conducting business activity (for purposes not directly related to their industry) have the right to withdraw from the contract without giving any reason within 14 days from receipt of goods.
2. To exercise the right to return, you must inform the Store about your decision (e.g. by e-mail to sklep@bamal.pl).
3. The goods must be returned to the Store's address immediately, no later than 14 days after the return is reported. The cost of returning the goods is borne by the Buyer.
4. The Store will refund all payments received (including the cheapest shipping cost offered to the customer) within 14 days of receiving the return notice. The Store may withhold reimbursement until the goods are received back.
§ 5. COMPLAINTS (NON-CONFORMITY OF THE GOODS WITH THE CONTRACT)
1. The store is obliged to deliver goods free from defects and in accordance with the contract.
2. If a defect in the goods is found, the Buyer is entitled to warranty rights or rights arising from the lack of conformity of the goods with the contract (in accordance with the provisions of the Consumer Rights Act).
3. Complaints should be submitted to the following address: sklep@bamal.plThe store will consider the complaint within 14 days.
4. It is recommended to check the condition of the shipment in the presence of the courier. If any mechanical damage occurs during transport, preparing a damage report will facilitate the complaint process, but it is not a necessary condition for filing a complaint.
§ 6. PERSONAL DATA PROTECTION (GDPR)
1. The controller of personal data is Bamal Europe LP Sp.k. Branch in Poland.
2. Data is processed solely for the purpose of fulfilling orders, handling complaints and (with additional consent) for marketing purposes.
3. The Customer has the right to inspect his/her data, correct it, request its deletion ("right to be forgotten") and limit its processing.
4. Detailed information on data protection can be found in the Privacy Policy at www.bamal.pl.
§ 7. FINAL PROVISIONS
1. The Store reserves the right to change the Terms and Conditions. Orders placed before the changes take effect will be processed based on the Terms and Conditions in effect on the date of purchase.
2. The Store informs about the possibility of using out-of-court complaint and redress procedures. Consumers can use the ODR platform: http://ec.europa.eu/consumers/odr/.
3. In matters not regulated, the provisions of the Civil Code and the Consumer Rights Act shall apply.
